These terms govern use of the MightyJoe Studio website. Client projects are governed by a separate signed project agreement.
Agreement to these terms
By accessing or using this website, you agree to these Website Terms and the Privacy Policy. If you do not agree, please do not use the website.
MightyJoe Studio is an independent digital studio operated by Joe Huynh in California. References to “MightyJoe Studio,” “the Studio,” “we,” “us,” or “our” refer to that operation.
Website information is not a proposal
Website descriptions, examples, packages, starting prices, availability, and timing are general information only. They may change and do not constitute a binding offer, guarantee, warranty, or project proposal.
Submitting a Project Blueprint, sending an email, participating in a call, or receiving a preliminary recommendation does not create a client relationship. A project begins only when both parties sign a separate project agreement and the required deposit is received.
Pricing, scope, and project timing
Mighty Launch starts at $1,500 and typically requires approximately 4–6 weeks. Mighty Growth starts at $3,000 and typically requires approximately 6–10 weeks. These are planning estimates, not guaranteed completion dates.
Actual price and timing depend on scope, current Studio capacity, content readiness, client feedback, revisions, third-party services, technical limitations, and requested functionality. A written project agreement will identify the controlling scope, deliverables, exclusions, payment schedule, and estimated timeline. Work outside that scope requires written approval and may change the price and schedule.
Client responsibilities
Prospective and active clients are responsible for providing timely, accurate, and authorized content, feedback, approvals, credentials, and access needed for the work. Clients must have the right to use any names, trademarks, copy, photographs, video, data, or other materials they provide.
Delays in content, access, decisions, consolidated feedback, approvals, or payment may pause or extend a project. Specific pause, rescheduling, cancellation, and refund terms belong to the signed project agreement.
Third-party services
Websites may rely on third-party products such as domain registrars, hosting providers, form tools, booking systems, analytics services, payment processors, social platforms, ecommerce platforms, or other integrations. Those services are governed by their own terms, pricing, availability, security, and privacy practices.
Unless a signed project agreement states otherwise, the Studio does not control and is not responsible for third-party outages, policy changes, account decisions, platform limitations, price changes, or discontinued features.
Post-launch support and Mighty Care
Unless a signed project agreement states otherwise, each completed website includes 30 days of post-launch support for correcting issues connected to the approved original build. This period does not include new content, new features, redesigns, changes in direction, or issues caused by third-party services.
When offered for an eligible Studio-built website, Mighty Care is an optional month-to-month service currently listed at $75 per month. It may include hosting and deployment management, domain and SSL connection oversight, routine uptime checks, source-file backup, small technical support requests, and up to 30 minutes of minor text or image updates during each paid month. Unused update time does not accumulate or roll over.
New pages, new sections, redesigns, functionality, integrations, substantial content work, migrations, emergency work caused by third parties, and third-party fees are outside Mighty Care and may require a separate quote. Response targets are not guarantees of completion or continuous availability.
Mighty Care may be canceled subject to the applicable billing terms. Service continues through the paid billing period. After cancellation, the client remains responsible for arranging independent hosting or an approved migration; cancellation does not include ongoing free hosting. Website ownership, account access, migration assistance, payment, suspension, and cancellation details are governed by the signed project or care agreement.
Intellectual property
The MightyJoe Studio name, website design, original website copy, logos, graphics, and other Studio materials are owned by or licensed to the Studio and may not be copied, republished, sold, or used to imply endorsement without permission.
Client ownership, licenses, reusable Studio tools, third-party materials, and the transfer of final project rights will be defined in the signed project agreement. Unless that agreement states otherwise, ownership transfer occurs only after all required payments are completed.
Portfolio and project labels
Portfolio work may be labeled as live, in development, concept, redesign study, beta, or another status. Concept work is illustrative and does not claim a completed client relationship. Client names, assets, results, or private project details will be published only when the Studio has appropriate permission.
Acceptable use
You may not misuse the website, interfere with its operation, attempt unauthorized access, submit malicious code or deceptive information, infringe another person’s rights, or use the site for unlawful purposes.
External links
This website links to other websites and Mighty products for convenience and portfolio context. The Studio does not control external sites and is not responsible for their content, availability, accessibility, security, or privacy practices.
Disclaimers and limitation of liability
The website is provided on an “as available” basis. To the fullest extent permitted by law, the Studio disclaims warranties regarding uninterrupted availability, error-free operation, completeness, or fitness for a particular purpose.
To the fullest extent permitted by law, the Studio will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of, or inability to use, this website. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited. Liability relating to client services is governed by the signed project agreement.
Changes and governing law
We may update these terms by posting a revised version and changing the effective date. These Website Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
